“Oxygen Media,” “Oxygen,” “Oxygen.Digital” – refer to Oxygen Media Ltd.
“Client” – refers to the individual or entity engaging Oxygen Media for services.
“Services” – refers to any marketing, design, website, or digital media service provided by Oxygen Media.
An invoice will be issued for agreed services.
The Client agrees to pay in full by the due date specified on the invoice.
Campaigns or project work will be paused if payment is not made by the due date.
Payments may be made by credit card, bank transfer, or other approved methods.
Services will not commence until payment is received and this agreement is acknowledged.
If this agreement is approved after the originally stated commencement date, the actual start date will be considered the official commencement date unless otherwise agreed.
Recurring service fees will be collected at the start of each billing period.
Billing may occur up to 7 business days prior to the service period.
Insufficient funds may result in campaign pausing and potential reactivation fees.
Late invoice payments will incur fees of 5% compounding daily interest if they remain unpaid for 45 days.
Clients must ensure sufficient funds are available for scheduled payments.
Credit card or bank detail changes must be submitted in writing at least 30 days before the next billing cycle.
Oxygen Media reserves the right to pause or cancel work due to missed payments.
Cancellation must be submitted using the Campaign Cancellation Form (available on request).
A minimum of 30 days’ notice is required.
Fixed-term contracts must be paid out in full if cancelled early.
No cancellations will be accepted without written confirmation from an authorised Oxygen Media representative.
All contracts automatically renew for a 3-month term unless notice is provided before the current term ends.
Quotes are based on the initial scope provided.
Additional work or changes outside the scope may incur additional charges.
Quotes include two (2) rounds of revisions unless otherwise stated.
Extra revisions will be billed at standard hourly rates.
Final payment for website work is due before go-live.
Clients have 30 days to report any issues with the delivered work.
Artwork/source files are available upon request for an additional fee.
Oxygen Media may showcase completed work in its portfolio unless explicitly requested otherwise.
Oxygen Media shall not be liable for indirect, incidental, special or consequential damages.
Our total liability is limited to the amount paid by the client for the services in question.
Any billing or service disputes must be raised within 14 days of occurrence.
We aim to resolve disputes within 2 business days of receiving written notice.
Refunds (if applicable) will be processed within 7 business days or applied to future invoices.
We comply with the New Zealand Privacy Act and are committed to protecting your data.

These Terms are governed by and construed under the laws of New Zealand. Any disputes shall be handled exclusively in New Zealand courts.
Oxygen Media is not liable for failure to perform due to causes beyond its control, including natural disasters, pandemics, labour shortages, internet outages, or acts of government.
By initiating services or making payment, the Client agrees to these Terms of Service.
